Mr. Raul Passerini, P.E. Page 7 <br />June 24, 2015 <br />The irrigation consumptive use credits resulting from the dry -up of 138 acres totals <br />111.3 acre-feet. Historical return flows from irrigation on this site are to be maintained by <br />continuing diversions through the Famine Ditch, the Old Whetstone Sheep Creek Ditch, the <br />South Rock Creek Ditch, and the McKay Ditch. Please note that approval of these credits does <br />not imply a position by this office in any subsequent change of water right or other litigation for <br />these water rights. In addition, note that a comprehensive stream depletion analysis <br />considering return flow lags may be necessary for approval of a plan for augmentation. <br />Replacement water to offset depletions during the non -irrigation season is to be <br />provided by releases from storage from Green Mountain Reservoir and Dillon Reservoir. The <br />schedule of releases from storage is outlined in the attached Tables 13 and 14. <br />Everist and the U.S. Bureau of Reclamation ("Bureau") entered into a long-term water <br />service agreement in 1993 for up to 25 acre-feet per year of industrial Green Mountain <br />Reservoir water to augment Everist's depletions to the Blue River (Contract No. 3-07- <br />60=W0902). This agreement was amended in 1994 to increase the amount of augmentation <br />water to 39 acre-feet per year. A second amendment was executed in 1998 to further increase <br />the augmentation water amount to 84 acre-feet per year. Of this total 17.37 acre-feet are to be <br />used for augmentation of out -of -priority depletions for Love Pit, pursuant to the decree in case <br />no. 96CW0176. An additional 6 acre-feet are required for the Everist's contract with Summit <br />County. The remaining 60.63 acre-feet are available to be used to replace out -of -priority <br />depletions for the Maryland Creek site. For 2015 and 2016, releases from Green Mountain <br />Reservoir are to total 34.86 acre-feet and 36.27 respectively, under the existing contract with <br />the Bureau. <br />A total of 3.3 acre-feet are available for release from Dillon Reservoir pursuant to an <br />agreement with the Board of Commissioners of Summit County. (A total of 4.3 acre-feet are <br />included in the contract; however, one acre-foot is dedicated to the operation of the <br />augmentation plan decreed in Case No. 96CW176, leaving 3.3 acre-feet available for use in this <br />SWSP.) For 2015 and 2016, no releases are to be made from Dillon Reservoir for this SWSP. <br />Conditions of Approval <br />I hereby approve the proposed SWSP in accordance with S 37-90-137(11), C.R.S., subject <br />to the following conditions: <br />1. This SWSP shall be valid from January 1, 2015 through December 31, 2016 unless <br />otherwise revoked or modified. If this SWSP will not be made absolute by a water <br />court action by the SWSP expiration date, a renewal request must be submitted to this <br />office with the statutory fee (currently $257) no later than November 15, 2016. <br />2. Well permit, Permit No. 78035-F was obtained for the current use and exposed pond <br />surface area of the gravel pit in accordance with S 37-90-137(2) and (11), C.R.S. <br />3. The total surface area of the ground water exposed at the Maryland Creek Ranch Pit <br />must not exceed 33.18 acres, which results in a maximum evaporative loss of 57.56 <br />acre-feet per year. <br />4. The annual water used for operational purposes at the Maryland Creek Ranch Pit shall <br />not exceed the following amounts: <br />• 3.1 acre-feet per year for dust control <br />• 3.4 acre-feet of water lost in the mined aggregate (104,000 tons) for 2015, <br />• 3.6 acre-feet of water lost in the mined aggregate (109,200 tons) for 2016 <br />• 7.8 acre-feet of water used for concrete production (84,564 cubic yard) for 2015 <br />
