AFFIDAVIT OF JOANNA HOPKINS <br />STATE OF COLORADO ) <br />SS. <br />COUNTY OF SUMMIT ) <br />I, Joanna Hopkins, being first duly sworn upon my oath, state as follows: <br />I am over the age of 21 and have personal knowledge of the matters set forth in this Affidavit. <br />I am employed by Everist Materials, LLC ("Everist") and am responsible for water matters <br />related to the aggregate mining operations conducted by Everist on the Maryland Creek Ranch <br />("MCR") located in Summit County, Colorado. <br />3. Overview <br />Everist operates the MCR aggregate resource operation, which includes aggregate mining from <br />wet pit(s), aggregate processing, concrete batching, and asphalt production. MCR is located in <br />Summit County, Colorado, on the West bank of the Blue River, approximately 6 miles <br />downstream of Dillon Reservoir and 20 miles upstream of Green Mountain Reservoir. The <br />mining operations at MCR take place at an elevation of approximately 8,550 feet, within a <br />distance of 2,200 feet of the Blue River, in Sections 15, 22, and 23, all in Township 4 South, <br />Range 78 West of the 6th P.M. <br />Mining in MCR began in the late 1990s under Permit # M-96-049 issued by the Colorado Division <br />of Reclamation, Mining and Safety (DRMS). It is estimated that mining operations will continue <br />for an additional 8 to 10 years. Following the cessation of mining, the pit(s) will be backfilled or <br />reclaimed as unlined ponds. Everist estimates that a total of three unlined ponds and depletions <br />from various wells will remain after cessation of mining. These ponds and wells are described <br />below. <br />Structures to be augmented <br />A. Cell 2 Pond, located in the SWI/4 SE1/4 of Section 15, T. 4S, R. 78W of the 61h P.M. <br />Mining is completed at this pit and it is filled with groundwater which is tributary to the Blue <br />River. The total surface area of exposed water is 5.1 acres. <br />B. Cell 3 Pond, located in the SEI/4 of Section 22, T. 4S, R. 78W of the 61h P.M. Mining is <br />currently occurring in this pit. Following cessation of mining, Cell 3 Pond will be reclaimed as <br />an unlined pond, tributary to the Blue River, with a surface area of 10.0 acres. <br />C. Cell 4 Pond, located in the NE1/4 of Section 22, T. 4S, R. 78W of the 61h P.M. Mining is <br />currently on-going in this pit. Following cessation of mining, Cell 3 Pond will be reclaimed as <br />an unlined pond, tributary to the Blue River. The surface area of exposed water will be 20.0 <br />acres. <br />D. Groundwater well Permit No. 515934, located in the SW1/4 SE1/4 of Section 15, T. 4S, <br />R. 78W of the 6th P.M., approximately 100 feet from the South Section line and 1,950 feet <br />
