Tuttle Draw <br />Pond 013 <br />A portion of the Pond 013 embankment, pool area, and associated outfall was constructed inside the <br />stream buffer zone for Tuttle Draw. The embankment and areas directly adjacent to the pond are very <br />well vegetated and do not exhibit any visual impacts from the presence of the pond and associated <br />structures inside the stream buffer zone. In accordance with Rule 4.05.18, the pond location within the <br />buffer zone has not caused or contributed to a violation of applicable water quality standards. As built, <br />the pond is capturing all surface water runoff from mining operations and discharging them through an <br />approved outfall location which is in compliance with New Horizon's mine current water quality <br />discharge permit. Furthermore, during and after mining, the Pond 013 location will not impact water <br />quantity or quality as it will be removed post mining and reclaimed to prime farmland. Finally, Pond 013 <br />does not create a temporary or permanent stream channel diversion. <br />Trench Drain Pipe <br />A trench drain (18" HDPE pipe) to convey spoil spring water from the backfill to the outfall on Pond 013 <br />(see Map 2.05.3(3)-21 for trench drain alignment) has also been constructed within the stream buffer <br />zone for Tuttle Draw directly adjacent to Pond 013. No ground disturbance has occurred within the <br />buffer zone due to the pipe laying on the ground surface, resulting in no adverse impacts to Tuttle <br />Draw. All water from the trench drain will be discharged into an outfall location upstream of the Pond <br />013 flume. <br />Ditch C-9 <br />Multiple portions of Ditch C-9 were constructed inside the stream buffer zone for Tuttle Draw. During <br />construction and to date, this has not created any adverse impacts to Tuttle Draw. As constructed, <br />Ditch C-9 functions as a collection ditch which captures surface water runoff from the disturbed and <br />reclaimed areas and conveys surface runoff to an approved sediment control structure (Pond 013). <br />Pond 012 <br />A portion of Pond 012, the embankment, pool area, and associated outfall was constructed inside the <br />stream buffer zone for Tuttle Draw. During construction and to date, this has not created any adverse <br />impacts to Tuttle Draw. The embankment and areas directly adjacent to the pond are very well <br />vegetated and do not exhibit any visual impacts from the presence of the pond and associated <br />structures inside the stream buffer zone. In accordance with Rule 4.05.18, the pond location within the <br />buffer zone has not caused or contributed to a violation of applicable water quality standards.
