I reviewed ownership and control information in the currently approved permit <br />application package and compared it to the information listed in the AVS. <br /> <br />The information provided by Seneca Coal Company (SCC) in the Seneca II-W mine permit <br />application package is inconsistent with what is listed in the AVS. Please forward this adequacy <br />concern to SCC: <br /> <br />The ownership and control information provided by Seneca Coal Company, LLC (SCC) in <br />the currently approved permit application package is inconsistent with the information <br />in the Applicant Violator System (AVS). The AVS is consistent with information provided <br />to DRMS by Peabody Energy Corporation (Cheryl Anderson) on June 17, 2015. Please <br />update the ownership and control information in the permit application package for <br />Peabody Colorado Operations, LLC, Peabody Operations Holding LLC, Peabody <br />Investments Corporation, and Peabody Energy Corporation. <br /> <br /> <br />To assist you in preparing your response, Information in the AVS database can be <br />viewed via a public facing portal located at: <br /> <br />https://avss.osmre.gov/Login.aspx?ReturnUrl=%2fsecure%2fhome.aspx <br /> <br />I requested an AVS application evaluation for SCC’s renewal application, based on the <br />corporate structure currently in the system; the system indicated there are no outstanding <br />violations. When SCC responds with updated ownership and control information, I will <br />query the system again.
