In your response you stated the existing closure on the upper portal would be removed. <br />During a telephone conversation on July 30, 2015, you clarified that the closure on the upper <br />portal is not contemplated under this NOI. Therefore, the closure on the upper portal may not be <br />removed as a part of the activities approved under this NOI. <br />As we discussed, you may modify your approved NOI at a later date to include removal of the <br />upper portal closure. Modifications to an existing NOI must be submitted in writing and <br />approved in advance of such activity.
