New Horizon Mine <br />I. General <br />Western Fuels -Colorado, L.L.C., New Horizon Mine, Permit No. C-1981-008 (dated October 29, <br />2013- latest renewal 6), is submitting this application for Phase I performance bond release. <br />New Horizon is requesting that a total of 107.8 acres be Phase I released with this application. <br />The current bond amount for the entirety of New Horizon Mine is $5,227,008, and the New <br />Horizon Mine currently holds a self -bond in the amount of $5,300,000. With this application, <br />New Horizon Mine is requesting relinquishment of 60% of the bond held for the parcels applied <br />for under this application. <br />II. Summary Information <br />A. General Location Description <br />The 107.8 acres requested for Phase I are located within Montrose County, Colorado and are <br />generally descripted as: <br />The El/z of the NWl/a, the Wl/z of the NEI/a, and the NEl/a of the NEI/4 of Section 1, Township <br />46 North, Range 16 West of the 6th P.M., County of Montrose, State of Colorado. <br />Please refer to Map 1 for the exact locations. <br />B. Public Notice <br />Pursuant to the Rules and Regulation of the Colorado Mined Land Reclamation Board <br />published August 1980, and pursuant to the Colorado Surface Coal Mining Reclamation Act <br />34-33-101, et seq., notice is hereby given of the filing of an application for Phase I Bond <br />Release on a portion of the New Horizon Mine site. The application pertains to the New <br />Horizon Mine, Permit No. C-1981-008 by Western Fuels — Colorado A Limited Liability <br />Company, P. O. Box 628, Nucla, Colorado 81424, filed with the Colorado Division of <br />Reclamation, Mining and Safety (CDRMS), Colorado Department of Natural Resources, 1313 <br />Sherman Street, Room 215, Denver, Colorado 80203. The New Horizon Mine is located <br />approximately 2 miles west of Nucla, Colorado. <br />These bond release areas were reclaimed in 2014 and 2015 and encompass 107.8 acres.
