(Tri-State), is the parent company to <br />Western Fuels -Colorado L.L.C., New Horizon Mine (New Horizon). Therefore, Tri-State on behalf of <br />the New Horizon Mine is notifying you that New Horizon is submitting an application for Phase 1 <br />performance bond release on areas reclaimed in 2014 and 2015. This application for Phase 1 release. <br />when submitted, will be denoted as Sl 16. A Phase I bond release includes an evaluation of the <br />backfilling and grading to the approved post -mining topography, as well as the establishment of <br />permanent drainages. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and <br />Safety (CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon must send <br />written notices of intention to seek bond release.
