The annual volume of ground water used for dust control shall not exceed 6.0 acre-feet, <br />and the annual amount of product mined shall not exceed 500,000 tons, which results in <br />14.71 acre-feet of ground water lost with the mined aggregate. No additional use of water <br />is allowed unless an amendment to this plan is obtained. <br />4. The lagged depletions associated with this mining operation must not exceed 132.92 acre-feet <br />during the period February 1, 2015 — January 31, 2016 and 148.39 acre-feet during the <br />period February 1, 2016 — January 31, 2017. Documentation of pond size may be required <br />by the Division Engineer in the form of an aerial photo evaluation or survey by a <br />Professional Land Surveyor during the term of this plan. <br />5. All diversions, including dust suppression, must be measured in a manner acceptable to the <br />division engineer and in accordance with the "Amendments to Rules Governing the <br />Measurement of Tributary Ground Water Diversions Located in the Arkansas River Basin". <br />6. Well permit no. 61403-F was previously issued for the exposure of up to 40 acres of ground <br />water; however, a new well permit must be obtained for the proposed exposure of up to <br />42.1 acres of ground water under this plan. A permit application (receipt no. 3667398) has <br />been submitted and is pending further action by this office. The provisions of § 37-90- <br />137(2), C.R.S., prohibit the issuance of a permit for a well to be located within 600 feet of <br />any existing well, unless the State Engineer finds that circumstances so warrant after a <br />hearing in accordance with the procedural rules in 2CCR402-5. The hearing will be waived if <br />you are able to obtain statements from the owners of all wells within 600 feet, verifying that <br />they have no objection to your use of the proposed well. Should a new well permit be denied <br />for reasons of 600 foot spacing, or any other legitimate reason, approval of this SWSP may be <br />cancelled. <br />7. Approval of this plan is for the purposes as stated herein. Any additional uses of this water <br />must first be approved by this office. Any future additional historic consumptive use credit <br />given (e.g., agricultural water transfer) for this site must consider all previous credits given. <br />8. Dewatering at this site will produce delayed depletions to the stream system. As long as <br />the pit is continuously dewatered, the water returned to the stream system should be <br />adequate to offset the depletions. However, once dewatering at the site ceases, the <br />delayed depletions must be addressed. Accordingly, dewatering is required to continue <br />during the term of this plan. At least three years prior to completion of mining, a plan must <br />be submitted that species how the post pumping dewatering depletions (including refilling <br />of the pit with ground water) will be replaced in time, place and amount. The Applicant is <br />hereby notified that if dewatering ceases, then depletions to the stream as a result of <br />refilling of the pit must be addressed as outlined by Guideline 14 of the April 1, 2011 <br />General Guidelines for Substitute Water Supply Plans for Sand and Gravel Pits. <br />9. Adequate accounting of depletions and replacements (in acre-feet) must be provided to the <br />Water Commissioner (Joshua. Kasoe[@state.co.us) and the Division Engineer <br />(Augmentation. Coordinator. CaD-state. co. us) on forms and at times acceptable to both of <br />them. The accounting form(s) shall be sufficient to demonstrate that the net effective <br />replacement equaled or exceeded the total depletion on a monthly basis. All replacement <br />water must be concurrent with depletions in quantity, timing and location, except that <br />releases aggregated at the discretion of the Division Engineer may occur in a later month <br />than the depletions.
