Czapla <br />Environmental Projection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Re' Notice of 110 Construction Materials Reclamation Permit Application Consideration Haynes Excavation, Inc., <br />Cottonwood Creek Fire Risk Mitigation Project, File No. M-2015-024 (HC #68611) <br />Dear Mr. Czapla: <br />Thank you for your correspondence dated July 14, 2015 (received by our office on July 20, 2015) regarding the <br />subject project. <br />A search of the Colorado Cultural Resource Inventory database indicated that no cultural resource inventories have <br />been conducted in the vicinity of the proposed permit area, and no historic properties have been recorded therein. <br />Our files contain incomplete information for this area, as most of Colorado has not yet been inventoried for cultural <br />resources. As a result, there is the possibility that as yet unidentified cultural resources exist within the proposed <br />permit area. <br />Should human remains be discovered during ground disturbing activities, the requirements under Colorado Revised <br />Statute 24-80 part 13 apply and must be followed. <br />Please also note that if this project falls under the direct or indirect jurisdiction of a Federal agency such as, but not <br />limited to, the Federal Emergency Management Agency, Section 106 of the National Historic Preservation Act as set <br />forth in 36 CFR Part 800 ("Protection of Historic Properties") may apply. If the project is considered an <br />undertaking, as defined by 36 CFR 800.16(y), the agency is required to identify historic properties (i.e. cultural <br />resources that are eligible to be listed in the National Register of Historic Places) located within the area of potential <br />effects and deterrnining whether the undertaking will have an effect upon such properties. The State Historic <br />Preservation Office, Native American tribes, representatives of local governments, and applicants for federal permits, <br />licenses or other approval are entitled to consultative roles in this process. <br />We thank you for the opportunity to comment.
