D. Fences, Bxisting fences maybe repaired and replaced,'and new fences' <br />may be built anywhere on the Property for purposes of reasonable and customary <br />management of livestock and wildlife, provided that such fences shall not exolude or <br />prevent wildlife from moving tbrough the Property, and are not otherwise inconsistent <br />with the preservation and protection of the Conservation Values, without any further <br />permission of Grantee. NotMthstanding the foregoing, fences that exclude wildlife may <br />be constructed for the purposes of protecting newly seeded and habitat restoration and <br />habitat management areas. <br />B. Utilities. Existing utilities may be repaired and replaced in the same <br />location with a similar structure without further permission of Grantee. Grantor may <br />install new utility lines or relocate existing utility lines only with permission of Grantee <br />Grantee determines said utility lines are not inconsistent with the preservation and <br />protection of the Conservation Values,. and such new or relocated utility lines shall be <br />installed underground. Additional utity lines or the relocation or significant upgrading <br />of existing utility lines may be'approved by Grantee if Grantee determines said utility <br />lines are not inconsistent with the preservation and protection of the Conservation Values. <br />,Any areas disturbed by the installation of new or relocated hiny lines <br />etiohall be . <br />revegetated and restored to a natural. condition promptly <br />g, Billboards and Signs. No commercial signs, billboards, awnings, or <br />advertisements shall be displayed or placed on the Property, except for appropriate and <br />customary ranch or pasture identification signs, "for sale" br "fox lease" signs alerting the <br />public to the availability of the Property for purchase or lease, "no trespassing" signs, <br />signs regarding $ie private leasing of the Property for hunting, fishing, or other low <br />impact recreational uses, and signs informing the public of the status of ownership. Signs <br />or billboards inconsistent with the preservation and protection of the Consezvation Values <br />are prohibited. <br />G. ,Re4=atzart. At the time of granting of this Deed, a Deed of <br />Conservation Basement has been granted on adjoining and nearby property by Marilyn L. <br />the "1`Zarilyn Richard CaM, ParegI, vvbich Deed of <br />Curry and Richard E. Cony ( 2008 as Reception No. <br />Conservation Basement was recorded on <br />of the records of the Delta County Clerk and Recorder (rhe Marilyn and <br />Richard Curry Conservation Basement'. Marilyn L. Curry, Richard E. Cony and <br />Thomas B. Curry, doing business as Tri -County Gravel, are the holders -of a permit issued <br />by the State of Colorado, Department of Natural Resources, Division ofame�e Marilyn <br />erals and' <br />Geology, Permit No. M-1977-205 (the "Gravel Permit"). This Property and <br />and gid Cunt► Parcel have been mined for sand and gravel pursuant to the Gravel <br />Permit; reclamation required by the Gravel Permit has been completed on most of the <br />property and that portion of the Property has been moved from the Gravel Permit <br />Pr erty.and. <br />through an acreage release. Final reclamation of a 5.5 -acre portion of the eunder the <br />the Marilyn and Richard Curry P areal (the `°Reclasnstion Area") is required <br />Gravel Permit. In conjunction with the granting of this Deed, Marilyn L. Curry, Richard <br />E. Curry, Theurer E. Curry, individually, and doing business as Tri -County Gravel; <br />NFRLk Colorado open Lands entered int&aReclamation Agreement dated recorded <br />on 2008, as Reception No. (.221 of the records of the Delta ' <br />County, Colorado, Clerk and Recorder (the `Teolamatfon Agreement").
