Colorado
Planning Department
1060 East 2nd Ave
Durango, CO 81301
(970)382-6263
July 24, 2015
Robin Reilley
Mined Land Reclamation Board
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
RE: King Coal Mine (C-1981-035) Technical Revision No. 25 (TR -25)
Dear Ms. Reilley:
Thank you for notification and the opportunity to provide comment on the King Coal Mine Technical Revision
No. 24. We reviewed the material submitted to the Division of Reclamation Mining and Safety (DRMS) related
to site drainage conveyance and detention in relation to a drainage study GCC submitted to the County on
September 5, 2013.
While DRMS regulations requires detention of the 25 -year storm for release at the historic 25 -year flow, La
Plata County Code requires detention of the 100 -year storm for release at the historic 100 -year flow. The data
provided to our two agencies are consistent with one another and demonstrate that the pond is of sufficient
size to meet county requirements.
Thus, our only concern is that periodic sediment removal occurs as required. Specifically, we request that
GCC's Operation and Maintenance plan specify, if it doesn't already:
1. That sediment be removed at 60% of maximum sediment level (based on our understanding of
DRMS requirements) and
2. The method of disposal of the sediment (handling, location, and any other DRMS requirements).
Thank you again for the opportunity to comment.
Sincerely,
Victoria Schmitt, PE
La Plata County Planning Engineer
Cc: Joe Kerby, County Manager
Damian Peduto, Community Development Director
Daniel Murray, Senior Planner
Sheryl Rogers, County Attorney
