6.4.13 -EXHIBIT M — OTHER PERMITS AND LICENSES <br />Ft. Lupton Special Use Permit and Annexation <br />An application for a Special Use Permit (SUP) has been submitted just previously to this <br />DRMS 112 Permit application to the City of Ft. Lupton, Colorado as part of the land use <br />permission granted to mine the Chavers Mining Resource. The SUP was submitted as <br />part of the process for annexation of this property to Ft. Lupton. Approval from Ft. <br />Lupton will be obtained through the SUP process before mining would begin on this <br />property. <br />Colorado Discharge Permit System (CDPS) State Discharge Permit/Stormwater <br />Permit <br />Prior to any ground -disturbing activities at the proposed permit area that would cause <br />the need for water discharge to the South Platte River, a CDPS/Stormwater Permit will <br />be obtained from the Colorado Department of Public Health and Environment (CDPHE) <br />that will account for any and all offsite discharge and will contain a plan for control of <br />that discharge. <br />Air Permits <br />Prior to any ground -surface disturbing activities (overburden removal and stockpiling, <br />access road development, haul road construction, or material hauling) for the Chavers <br />Mining Resource, the operator will obtain a site Fugitive Dust Permit from the CDPHE <br />for these activities. This permit will be kept active during the entire life of the mine. <br />State Engineers Temporary Substitute Water Supply Plan/Gravel Pit Permit <br />A Temporary Substitute Supply Plan (TSSP) was submitted to the State Engineer for <br />review and approval in 2008 as part of the original process for this DRMS submittal and <br />initial review comments were received back from the consulting reviewer. This process <br />will be repeated again as part of this new submittal and prior to commencement of any <br />mining operations on the Chavers Mining Resource, TSSP plan approval will be <br />obtained from the State Engineer. <br />July 2015 Chavers Mining Resource <br />Regular 112 Permit Application <br />
