OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Financial Warranty <br />PROBLEM/POSSIBLE VIOLATION: Problem: The financial warranty is not adequate to reclaim the site in <br />accordance with the approved reclamation plan. This is a failure to maintain the proper financial warranty <br />amount to complete reclamation of the affected lands pursuant to C.R.S. 34-32.5-117(4)(b) of the Act. <br />CORRECTIVE ACTIONS: The Operator will likely be required to submit an amendment or conversion application <br />to the division to resolve the existing boundary issue. The Financial Warranty will be addressed as a required <br />component of the conversion/amendment submittal. The operator shall submit adequate financial warranty as <br />determined by the Division. If the operator demonstrates to DRMS that the existing disturbance is less than or <br />equal to 9.4 acres, DRMS will issue a separate surety increase under separate cover. <br />CORRECTIVE ACTION DUE DATE: to be set. <br />INSPECTION TOPIC: Off-site Damage <br />PROBLEM/POSSIBLE VIOLATION: Problem: Problem: Based on observations made during this inspection, DRMS <br />believes that land in excess of the 9.4 permitted acres has likely been affected. If this is found to be the case, it <br />would be a possible violation pursuant to: C.R.S. 34-32.5-116(4)(i) for failure to protect areas outside of the <br />affected land from slides or damages occurring during the mining operation. <br />CORRECTIVE ACTIONS: The operator will have until August 31, 2015 to or submit a complete application (fee, <br />completed application form, and all required exhibits) for a permit conversion or amendment to DRMS to <br />resolve the existing boundary issue, or demonstrate to DRMS via a site survey conducted by a registered <br />surveyor that the total existing disturbance is less than or equal to 9.4 acres. <br />If the boundary issue is unresolved by August 31, 2015 DRMS will pursue a possible violation through a hearing <br />Page 1 of 4 <br />
