New Horizon Mine <br />data. Please see Appendix B which documents the sediment contributions for the areas being <br />applied for Phase II release. <br />F. Rill and Gullies <br />All rills and gullies that may have occurred during the initial years of revegetation were <br />mitigated when they occurred. Erosion control methods implemented for these Phase II areas <br />have been successful and the areas are stable and free of erosion. Successful revegetation efforts <br />have ensured and will continue to guarantee these areas remain free of erosion. <br />G. Pond 008 Retention <br />Pursuant to Rule 3.03.1(5), with this application Pond 008 and three associated ditches will <br />remain at the request of the surface landowner; therefore it is requested that these sediment <br />control structures be release of the applicable bond. Attachment 2.05.3(3)-19 of the approved <br />permit package provides a demonstration on the retention of Pond 008, and a surface landowner <br />letter requesting one (1) pond is constructed post mine (Pond 008) in lieu of the three (3) that <br />were on the land pre -mining. <br />SL -15 Phase II Bond Release Application Page 6 <br />
