New Horizon Mine <br />I. General <br />Western Fuels -Colorado, L.L.C., New Horizon Mine, Permit No. C-1981-008, is submitting this <br />application for Phase II performance bond release. New Horizon is requesting that a total of 77.4 <br />acres be Phase II released with this application. The current bond amount for the entirety of <br />New Horizon Mine is $5,227,008, and New Horizon currently holds a self -bond in the amount of <br />$5,300,000. With this application, the New Horizon Mine will be requesting relinquishment <br />of 25% of the base bond held for these parcels. <br />II. Summary Information <br />A. General Location Description <br />The 77.4 acres requested for Phase II are located within Montrose County, Colorado, in Section <br />31, Township 47 North, Range 15 West, and Section 36, Township 47N, Range 16 West, of the <br />New Mexico Principal Meridian. Please refer to Map 1 for the exact locations. <br />B. Public Notice <br />Pursuant to the Rules and Regulation of the Colorado Mined Land Reclamation Board, published <br />August 1980, and pursuant to the Colorado Surface Coal Mining Reclamation Act 34-33-101, et <br />seq., notice is hereby given of the filing of an application for Phase II Bond Release on a portion <br />of the New Horizon Mine. The application pertains to the Western Fuels -Colorado, A Limited <br />Liability Company, New Horizon Mine, Permit No. C-1981-008, P.O. Box 628, Nucla, CO <br />81424, filed with the Colorado Division of Reclamation, Mining and Safety (CDRMS), Colorado <br />Department of Natural Resources, 1313 Sherman Street, Room 215, Denver, Colorado 80203. <br />The New Horizon Mine is located approximately 2 miles west of Nucla, Colorado. <br />The bond release areas applied for, contains areas reclaimed from 2005-2009, totals 77.4 acres, <br />and are shown in detail in Map 1 within the application. Listed below is a general legal <br />description of these areas: <br />Township 47 North, Range 15 West of the New Mexico Principal Meridian <br />Section 31 — SW 1/4 <br />Township 47 North, Range 16 West of the New Mexico Principal Meridian <br />Section 36 — SE '/4 <br />The New Horizon Mine currently holds a self -bond in the amount of $5,300,000, which includes <br />the above listed areas. With this application, the New Horizon Mine will be requesting <br />relinquishment of 25% of the base bond held for these parcels. Map 1 shows all of the <br />reclaimed areas by reclaimed year.
