(Tri-State), is the parent company to <br />Western Fuels -Colorado L.L.C., New Horizon Mine (New Horizon). Therefore, Tri-State on behalf of <br />the New Horizon Mine is notifying you that New Horizon is submitting an application for Phase 11 <br />performance bond release on areas reclaimed from 2005 through 2009. This application for Phase 11 <br />release, when submitted, will be denoted as SL -15. A Phase II bond release application focuses on <br />vegetative cover and species composition in support of the post mine land use. Additionally, a Phase 11 <br />evaluation demonstrates the contribution of suspended solids to streamflow or runoff is not in excess of <br />pre -mining levels or levels documented for comparable non -mined areas. Finally, the Phase 11 application <br />demonstrates that topsoil depths are in compliance with the approved mining permit. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, Mining and <br />Safety (CDRMS) Rule 3.03.2(1). Prior to filing a request for the bond release, New Horizon must send <br />written notices of intention to seek bond release.
