TWENTYMILE COAL, LLC -FOIDEL CREEK MINE PR15-11, DEVELOPMENT AND MINING OF THE WOLF CREEK RESERVE COMPLETENESS RESPONSES 07/15 1) The Summary of Revisions/Additions table indicates that a new exhibit; Exhibit 7K — Wolf Creek Reserve Subsidence Evaluation, is to be included with PR11. This exhibit was not submitted with PRI L Please submit this exhibit. Response: A copy of Exhibit 7K was not included with the PR15-11 submittal package because the CDRMS already has two copies which were previously submitted (supplemental materials submitted March 19, 2014) as part of the PR14-10 submittal, and this exhibit does not change for the PR15-11 submittal. Exhibit 7K is included in the Summary of Revisions/Additions as a relevant component of the PR15-11 submittal. The Summary of Revisions/Additions has been revised to note the previous submittal, with a revised copy accompanying these responses. Based, however, on a phone conversation with the CDRMS Reclamation Specialist, Twentymile Coal, LLC (TC) is providing a duplicate copy of the exhibit with these responses for inclusion in the PR 15-11 package. 2) The Summary of Revisions/Additions table indicates that Exhibit 53 — Wolf Creek Reserve Geologic and Mine Plan Information, is to be revised with PRI L A coversheet for this exhibit was included with the submittal, but revised pages were not included. Please clarify if this exhibit is to be revised with PRII; if so, please submit the revised pages. Response: Exhibit 53 was previously submitted and approved as part of the TR13-83 submittal, and this exhibit does not change for the PR15-11 submittal. Exhibit 53 is included in the Summary of Revisions/Additions as a relevant component of the PR15-11 submittal. The Summary of Revisions/Additions has been revised to note this previous submittal/approval, with a revised copy accompanying these responses. Given that Exhibit 53 is an approved part of the PAP package, it is not necessary to provide a duplicate copy with the PRI 5-11 submittal. 3) Section 2.04.4 of the permit was not updated to address the requirements of Rule 2.04.4 regarding the proposed increase of 150 acres of affected area associated with mining in the Wolf Creek Reserve. Please update this section of the permit with the information required from Rule 2.04.4. Response: Through an oversight, cultural resource coverage for the referenced area was not addressed, as noted in the comment. We are currently checking with our archaeology contractor relative to previous coverage for this area. We have an archaeology field team on-site doing some other work, and will work with them to complete supplemental coverage as necessary to address any areas not covered by previous surveys. The referenced text section has been reviewed and revised to reflect these considerations, and a report will be submitted, following receipt from the contractor and our internal review, addressing any areas not previously surveyed. 4) The public notice submitted with the application indicates the ownership, precise location, and boundaries of lands within the Permit are identified on pages "2.03-13 through 2.08-18... ". Please correct this to read "2.03-13 through 2.03-18... ". Response: The noted minor typo has been corrected, and a copy of the revised notice accompanies these responses.
