ReclaimWole Agre=eut provides for reclamation of the Reclamation Area to be. <br />completed incompliance with the.Gravel Permit, and further, reclamation of the Property <br />to be completed in compliance with the Reclamation Plan described in the Reclamation <br />Agreement ("Reclamatian"). Reclamation of the Recl�a#on , as required iu the <br />Gravel Permit, and additional reclamation required by the Reclamation Agreement and <br />the Reclamation Plan, is permitted on the Property. .All Reclamation shall be completed <br />in accordance with the Gravel Permit, the Reclamation Agreement and the Reclamation <br />Plan, not later than January 1, 2013 unless an extension is approved by Grantee, the <br />Board, and CDOW. In addition to being executed individually by Thomas B. Curry, this <br />Deed has been executed by Marilyn L. Curry, Ridbard. E. Curry and Thomas B. Curry, <br />d/b/a Tri -County Gravel, as holder of the Gravel Permit, for the purpose of <br />admowledging that Mining is prohibited on the Property, and that Mining shall not occur <br />on the Property under the Caravel Permit. <br />5. Resource Management. Grantor recognizes the importance of good resource <br />management and stewardship to preserve and protect the Conservation Values. Grantor and <br />Grantee acknowledge that the Property has been and is currently being managed for ranching, <br />low -impact recreational (defined below), and agricultural purposes in a manner that also <br />preserves and protects the Conservation Values. Grantor and Grantee also acknowledge that <br />significant habitat management activities could be implemented on the Property. It is Grantor's <br />intent that the Property continues to be operated and managed to permit ranching, personal low= . <br />impact recreational, and agricultural purposes that are not inconsistent with the preservation and <br />protection of the Conservation Values. Nothing herein shall be construed as of fording the public <br />access -to the uplands, river banks, or river bed of the Property, other than visual. access. <br />In support of these msnagemput goals, both Grantor and Grantee recognize that without a <br />management plan, firttue owners or managers of the Property may wish to employ land <br />management practices that are inconsistent with the preservation and protection of the <br />Conservation Values. Accordingly, the Property shall be operated and managed in accordance <br />with auianagement plan that has been accepted by all parties and approved in wxtting by CDOW <br />(the "Management Plan"). The Management Plan shall be reviewed by Grantor and Grantee at <br />least every five years, and updated if necessary, at Grantor's expense. Management Plan updates <br />shall be accepted with the mutual consent of Grantor anal Grantee, and- shall be approved by <br />CDOV%T in writing. <br />Grantor agrees that the following uses of and practices on the Property shall be conducted <br />in accordance with the provisions below. In the event Graatea believes at any that the. <br />resovrce management practices are not consistent with the Pres ervadon and protection of the <br />Conservation Values, Grantee may reqs that Grantor and Grantee shall, at Grantor's expense, <br />consult with a mutually agreed upon conservation professional. This professional will provide <br />written suggestions for the presQrvafiion and protection of the Conservation Values regarding the <br />following uses and practices: agricultural., timber, mining,.water, wildlife, low-inxpact <br />recreational, or other uses and management practices. <br />A. .4gricultw e. The Properly shall be managed to prevent ovesgrazi4g by <br />livestock and soil erosion.
