satisfaction of the Division of Reclamation, Mining, and Safety, and the Property has been
completely released from the Gravel Permit. In 2009, the mining permit was conveyed to United
Companies in violation of Section 53,of the Reclamation Agreement.
As we discussed on the phone today, you will be visiting the Curry property in the next couple of
weeks to make an assessment of whether the 5.5 acre site has been adequately reclaimed to
submit a request to DRMS to release the permit. If it is determined that the slte has not been
adequately reclaimed, we request that you provide us with a plan forreclamation which includes
the specific reclamation activities and proposed timeline for completion. Because the
reclamation was required to be completed by January ls` 2013 and is now more than two years
overdue; we appreciate your prompt attention to this matter.
We appreciate your willingness to work with us, the Curty's, and the Western Slope
Conservation Center to fulfill the obligations set forth in the Conservation Easements and
Reclamation Agreements. Specifically, that the 5.5. acre portion of the Tom Curry property be
released from the Gravel Permit.
Please do not hesitate to contact me with any questions.
Sincerely,
Cheryl
44
Director of Land Stew 44dship
303-988-2373 x 219
ccufre@coWWooperilainds.org
Attachments:
Deed of Conservation Easement, Pages 1, 6-7
Reclamation Agreement, page 1
cc:
Thomas Curry
PO Box 566
Hotchkiss, CO 81419
Sara Sauter
Western Slope Conservation Center
PO Box 1612
Paonia, CO 91428
