TL I <br />WDNR <br />CO 155 <br />L, -July 16, 2015 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Mr. Larry Laughrey, <br />Estate of Frank Laughrey <br />P O Box 153 <br />Forbes Town, CA 95941 <br />Re: Tiger Timber Site, Permit M-1_991-082; <br />E <br />Reason to Believe a Violation xists and Notice of Board Hearing <br />Dear Mr. Laughrey: <br />On May 11, 2015, the Division of Reclamation, Mining and Safety (Division) mailed you a letter <br />notifying you of Financial Warranty Increase as a result of the Division's denial of Succession of <br />Operator application to Tiger Timber and Gravel Co (a.k.a. Tiger Timber and Gravel, LLC) for <br />the Tiger Timber Site (Permit M-1991-082). The increased financial warranty was due to the <br />Division on July 10, 2015. As the Division has not received the additional financial warranty, we <br />believe this is a violation of: <br />• C.R.S. 34-32.5-117(4)(c)(II) and Rule 4.2.1(2) for failure to post additional financial <br />warranty within 60 days after notice of adjustment. <br />Therefore, the Division has reason to believe that a violation exists to the Mined Land <br />Reclamation Act, C.R.S. 34-32.5-101 et sem., and have scheduled this matter to appear before the <br />Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the August 26, 2015 Board Meeting for <br />consideration of these possible violations. The hearing will be held in Room 318 of 1313 <br />Sherman Street, Denver, Colorado, beginning at 9:00 a.m. on August 26, 2015 or as soon <br />thereafter as the matter can be considered. At that hearing you will have the opportunity to <br />present your defense. <br />This is an important legal proceeding and you must appear in person for this hearing. If <br />you fail to appear an order and money judgment may be entered against you.
