PERMIT #: M-1990-098 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: July 10, 2015 <br />OBSERVATIONS <br />The Perry Pit was inspected by Peter Hays and Wally Erickson with the Division of Reclamation, Mining and <br />Safety (Division/DRMS) as a follow up inspection to verify completion of corrective actions cited during <br />previous inspection. Representatives from Northern Colorado Constructors and Consolidated Mutual Water <br />were not present during the inspection. <br />During the July 10, 2015 inspection the following problem was cited: <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to repair the erosion gully located in the <br />southeast corner of the Consolidated Mutual property between the east bank of the Platte River and <br />the Aggregate Industries property line after the 2013 flood event. Therefore, the Division believes <br />Northern Colorado Constructors failed to maintain the prevailing hydrologic balance in the area as <br />required by Rule 3.1.6 and Section 34-32.5-116(4)(h) of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials. <br />CORRECTIVE ACTIONS: The Operator must work with the Army Corps of Engineers and Aggregate <br />Industries to return the Platte River to its channel within 10 days of the mailing date of this report. <br />CORRECTIVE ACTION DUE DATE: 7/18/15 <br />Mr.1.C. York with AT Consulting, Inc., consultant for Northern Colorado Constructors and Consolidated Mutual <br />Water Company notified the Division concrete rubble had been placed across the beached area and the Platte <br />River was back in its channel on July 15, 2015. <br />Concrete rubble was observed along the east bank of the Platte River across the breached section of river bank. <br />Placement of overburden material was occurring behind the concrete rubble. Overburden was being <br />excavated from the east end of the overburden stockpile located north of Cell 3 in the Aggregate Industries site <br />during the inspection. The flow of the Platte River across the land owned by Consolidated Mutual and <br />Aggregate Industries was reduced to a minimal amount. The problem cited requiring the Operator to work <br />with the Army Corps of Engineers and Aggregate Industries to return the Platte River to its channel has been <br />resolved satisfactorily by the corrective active due date. <br />A copy of the approved Army Corps of Engineers Nationwide Permit 45, Action No. NWO-2015-1238-DEN, was <br />emailed to the Division by J.C.
