PERMIT #: M-1989-120 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: July 17, 2015 <br />OBSERVATIONS <br />The Platte Valley Operation was inspected by Peter Hays and Wally Erickson with the Division of Reclamation, <br />Mining and Safety (Division/DRMS) as a follow up inspection to verify completion of corrective actions cited <br />during previous inspection. A representative from Aggregate Industries was not present during the inspection. <br />During the June 26, 2015 inspection the following problem was cited: <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to maintain the approved offset distance along <br />the western shoreline of the Phase 3 pond, repair the head cut erosion feature since its first occurrence in <br />2008 and repair the erosion gully after the 2013 flood event. Therefore, the Division believes Aggregate <br />Industries failed to maintain the prevailing hydrologic balance in the area as required by Rule 3.1.6 and Section <br />34-32.5-116(4)(h) of the Colorado Land Reclamation Act for the Extraction of Construction Materials. <br />CORRECTIVE ACTIONS: The Operator must work with the Army Corps of Engineers and Consolidated Mutual <br />Water to return the Platte River to its channel within 10 days of the mailing date of this report. <br />CORRECTIVE ACTION DUE DATE: 7/18/15 <br />Mr. J.C. York with AT Consulting, Inc., consultant for Northern Colorado Constructors and Consolidated <br />Mutual Water Company notified the Division concrete rubble had been placed across the beached area and <br />the Platte River was back in its channel on July 15, 2015. <br />Concrete rubble was observed along the east bank of the Platte River across the breached section of river <br />bank. Placement of overburden material was occurring behind the concrete rubble. Overburden was being <br />excavated from the east end of the overburden stockpile located north of Cell 3 in the Aggregate Industries <br />site during the inspection. The flow of the Platte River across the land owned by Consolidated Mutual and <br />Aggregate Industries was reduced to a minimal amount.
