PERMIT #: P-2009-009 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: June 25, 2015 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). In addition, Amy Titterington and Kelsa Warner of the U.S. Forest Service (USFS) were also present <br />for the inspection. Mike Wild with Atomic Perfection Inc. was present on behalf of the Operator. The Wild <br />Blue Indian Lode is located in Park County, approximately12 miles north of Lake George, Colorado. The Wild <br />Blue Indian Lode operates under a Notice of Intent to Conduct Prospecting (NOI); the commodities of interest <br />are pegmatite. <br />The purpose of this inspection was to follow up on corrective actions issued during an inspection conducted <br />on November 21, 2015. The Division cited four problems during the last inspection; the following is a list of the <br />cited problems, the current statuses of the corrective actions and observations made during this inspection: <br />1. The Division observed that several of the excavations did not have safety fencing around the entire <br />perimeter of the trenches. Pursuant to Hard Rock Rule 5.3.1(f), the Operator is to safeguard mine entries, <br />trenches and excavations from unauthorized entry at all times as necessary to provide for public safety. Since <br />the last inspection, the Operator has erected orange safety fencing around all of the excavations. The Division <br />considers this problem to be resolved. <br />2. The Division requested the prospector file an application for a Reclamation Permit to conduct mining. The <br />request was based in part on the assumption that prospecting at the Wild Blue Indian Lode had been ongoing <br />since 2009. However, the Division has been informed that the USFS did not approve the Plan of Operations <br />until 2012. Therefore, prospecting at this site has been occurring for approximately three seasons. As a result, <br />the Division will withdraw the request to obtain a Reclamation Permit at this time. The Division reserves the <br />right to make a future determination that the activities being conducted under this NOI meet the definition of <br />a mining operation, as defined in C.R.S 34-32-103(8). <br />3. The Division observed sediment being transported from stockpiles into adjacent drainages. The Operator has <br />erected silt fencing around the base of the stockpiles adjacent to USFS access road. The Division did not <br />observe any sediment leaving the site and considers this problem to be resolved. The Operator is responsible <br />for ensuring that silt fencing, or other erosion control methods, are employed for all stockpiles during the <br />active prospecting season. <br />4. The Division observed topsoil was not being segregated and salvaged. The Operator has salvaged topsoil <br />from the open excavations and has stockpiled the topsoil around the perimeter of the trenches. Topsoil in this <br />area is minimal and ranges between 2 to 6 inches. The Operator shall continue to ensure that all available <br />topsoil is salvaged and preserved for use during reclamation. The Division considers this problem to be <br />resolved. <br />In addition to the above referenced work, the Operator has reclaimed four trenches and two test pits. <br />Currently there are 3 open trenches. The Operator is authorized to affect up to one acre of land; the amount <br />of disturbance is currently below this threshold. The Division and the USFS hold a financial warranty in the <br />amount of $5,072.00, which has been determined to be adequate to complete reclamation of the site. <br />This concluded the inspection. <br />Page 2 of 3 <br />
