(Tri-State), is the parent <br />company to Axial Basin Coal Company, which is the general partner to Colowyo Coal Company <br />L.P. (Colowyo). Therefore, Tri-State on behalf of Colowyo is submitting this adequacy response <br />for TR -105 to Permit No. C-1981-019. Tri-State received your adequacy comments dated May <br />20, 2015, and has the following response to comment 16. <br />16. In the cover letter for Technical Revision 105 Tri-State states that they have consulted <br />landowners with regards to the proposed post -mining topography and received verbal <br />approval for the changes. Please provide the Division with written verification of <br />landowner approval for the proposed post -mining topography. These letters should <br />include, at a minimum, BLM and CPW. <br />Response: On August 20, 2014, Tri-State met with Mr. Jerod Smith from the Colorado State <br />Land Board, Mr. Jeff Goncalves with Colorado Parks and Wildlife, and Mrs. Jennifer Maiolo <br />and Mr. Hunter Seim of the Bureau of Land Management and presented the proposed post - <br />mine topography submitted under TR -105. All parties were informed on how the proposed <br />changes to the post -mine topography affected each individual landowner property, and they <br />were also presented with the opportunity to ask any questions they may have had. All parties <br />verbally- agreed to the proposed post -mine topography presented during the meeting. <br />At the request of the Division on May 20, 2015, each landowner has provided a concurrence <br />letter indicating they agree with the proposed post -mine surface submitted under TR -105. A <br />copy of each letter has been included under with this response.
