The Division is <br />providing a response to your letter. Items 1, 3, 4 and 5 are considered resolved. Items No. 2 remains <br />outstanding. Please see the details below. <br />1. The Summary of Revisions and Additions table submitted with MR288 indicated Twentymile <br />Coal, LLC. (TC) proposes to replace pages 2.05-45.21, 45.22, 45.23, 45.24 and 45.25. These <br />pages were not submitted with MR288. Please submit these pages or revise the Summary of <br />Revisions and Additions table. <br />a. TC's Response: The Summary of Revisions and Additions has been revised, and a copy <br />is attached. Please note that this Summary is provided as a courtesy to simplify and <br />facilitate review and processing, and is not a required part of the application, thus, should <br />not be a completeness consideration. <br />b. Division's Response: The Division appreciates the submittal of the Summary of <br />Revisions and Additions table as it does help facilitate our review. However, if the <br />instructions provided by the table indicate a page should be replaced with a revision and <br />that page is not included with the submittal, the Division considers these missing pages a <br />completeness issue. It appears the pages in question are not to be revised based on the <br />updated Summary of Revisions and Additions table and per our telephone discussion. <br />This issue is considered resolved. <br />2. Map 23c needs to be revised and updated to account for the surface disturbance associated with <br />MR288. <br />a. TC's Response: Map 23C includes (as indicated by the legend); an outline of the <br />underground mine workings, the railroad spur, roads, surface impoundments, and water <br />monitoring locations. It does not show mine facilities, so it would not be appropriate to <br />include the proposed pipeline locations on this map.
