Dear Mr. Cunningham,
Clear Creek County requests that the Division of Reclamation Mining and Safety
("Division") grant an extension for public comment on Santiago Mining Co., LLC's ("Santiago
Mining") Notice of Intent to Conduct Prospecting Operations application, DRMS File No.
P-2015-016 ("NOI"), based on the facts set forth in this letter.
Santiago Mining filed its NOI with the Division and the Division posted the NOI on its
website on June 30, 2015. See attached Letter dated July 1 ("Letter'). The Letter states the
public comment deadline is July 15, 2015, ten working days after the NOI was posted on the
Division's website. See Letter. Santiago Mining submitted notice of the NOI to the Clear
Creek County Board of County Commissioners ("Board") on July 8, 2015, even though the
Notice is dated July 3. See attached Notice dated July 3 ("Notice'). The Notice was
personally delivered to the County Attorney's Office, who accepted delivery on behalf of the
Board, on July 8. The Notice did not include a copy of the NOI and did not state that the NOI
was available on the Division's website.
Pursuant to the Colorado Code of Regulations, when an entity submits a Notice of Intent
to Conduct Prospecting Operations application, that entity must concurrently submit notice of the
application to the local Board of County Commissioners where the prospecting activities will
occur. 2 Colo. Code Regs. § 407-1:5(M). Further. the notice of the application submitted to
the local Board of County Commissioners must include that the application is available on the
Division's website. 2 Colo. Code Regs. § 407-1:5(m)(ii).
