Cunningham DNISION OF <br />Colorado Division of Reclamation Mining and Safety MINING AND SAFETY <br />1313 Sherman St. <br />Suite 215 <br />Denver, CO 80203 <br />Vis E -Mail and Hardcopy <br />RE: Santiago Mine; DRMS File No. P-2015-016; Request for Extension of Time to <br />Comment on Notice of Intent to Prospect. <br />Dear Mr. Cunningham, <br />Clear Creek County requests that the Division of Reclamation Mining and Safety <br />("Division") grant an extension for public comment on Santiago Mining Co., LLC's ("Santiago <br />Mining") Notice of Intent to Conduct Prospecting Operations application, DRMS File No. <br />P-2015-016 ("NOI"), based on the facts set forth in this letter. <br />Santiago Mining filed its NOI with the Division and the Division posted the NOI on its <br />website on June 30, 2015. See attached Letter dated July 1 ("Letter'). The Letter states the <br />public comment deadline is July 15, 2015, ten working days after the NOI was posted on the <br />Division's website. See Letter. Santiago Mining submitted notice of the NOI to the Clear <br />Creek County Board of County Commissioners ("Board") on July 8, 2015, even though the <br />Notice is dated July 3. See attached Notice dated July 3 ("Notice'). The Notice was <br />personally delivered to the County Attorney's Office, who accepted delivery on behalf of the <br />Board, on July 8. The Notice did not include a copy of the NOI and did not state that the NOI <br />was available on the Division's website. <br />Pursuant to the Colorado Code of Regulations, when an entity submits a Notice of Intent <br />to Conduct Prospecting Operations application, that entity must concurrently submit notice of the <br />application to the local Board of County Commissioners where the prospecting activities will <br />occur. 2 Colo. Code Regs. § 407-1:5(M). Further. the notice of the application submitted to <br />the local Board of County Commissioners must include that the application is available on the <br />Division's website. 2 Colo.
