Scott, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: Sarah Brucker, P.E. 6-1V
RE: Star Water Resource (formerly Feit Pit), File No. M-1977-522_ 5 t
Operator: L.G. Everist, Incorporated
Contact: Dennis L. Fields, (303) 287-4656
Section 26, Twp 6 North, Rng 66 West, 6th P.M., Weld County
COMMENTS: The applicant has requested a financial warranty reduction for the remaining 81.27 acres of
the permit area (9.36 acres were previously released). L.G. Everist completed mining at the site last
year and has nearly completed reclamation at the site, with only some additional revegetation work
remaining. The applicant provided a breakdown of the estimated reclamation costs remaining in support
of their financial warranty reduction request. The applicant has not requested any acreage to be
released at this time.
The slurry wall liner for the Everist Star Reservoir on the western portion of the site was approved by this
office as meeting the design standard in a letter dated December 16, 2014 and is now classified as a lined
reservoir. (A subsequent approval letter dated March 6, 2015 was issued to correct the WDID for the
structure.) A site inspection performed by your office on June 18, 2015, found that the exposed ground
water lake on the eastern portion of the site has been backfilled to reduce the exposed ground water
area to the pre -1981 area (6.1 acres). The Star Water Resource (formerly the Feit Pit) is included in the
L.G. Everist Combined Substitute Water Supply Plan (WDID 0202618), as amended May 26, 2015, which is
valid for operation through December 31, 2015. The Star Water Resource must continue to be included in
a substitute water supply plan until lagged depletions to the stream system from past operations at the
site have ceased.
This office has no objection to the request for financial warranty reduction. The applicant may contact
the State Engineer's Office with any questions.
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 555.555.5555 www. water. state. co. us
