Public Services — Watershed Protection District <br />13.50.150 Violations and penalties. <br />(a) It shall be unlawful for any person to <br />engage in or cause a violation of any provision of <br />this Chapter or of any term or condition of any <br />watershed permit, and such person shall be fined <br />upon conviction thereof in an amount up to one <br />thousand dollars ($1,000.00), and/or imprisoned <br />up to one (1) year in jail. <br />(b) Any development, activity, facility or <br />structure which is continued, operated or main- <br />tained in violation of this Chapter or the terms <br />and conditions of any watershed permit shall be <br />subject to injunction, abatement and/or other <br />appropriate legal remedy as may be sought and <br />obtained by the Town, in which event the Town <br />shall be entitled to recover its reasonable costs <br />and attorney fees from the offending party or <br />parties. <br />(c) All penalties and remedies for viola- <br />tions of this Chapter shall be nonexclusive and <br />cumulative, and the Town's pursuit and/or exer- <br />cise of one (1) remedy or penalty shall not fore- <br />close or prohibit the pursuit and exercise of <br />alternative or other remedies. (Ord. 517 § 1, <br />2000) <br />CHAPTER 13.60 <br />Water Conservation <br />13.60.010 Purpose and applicability. <br />Water being a finite and precious resource <br />necessary for the preservation and advancement <br />of the public health, safety and welfare, it is the <br />purpose of this Chapter to regulate water use so <br />as to promote the conservation of the Town's <br />water resources, prevent waste, insure adequate <br />and consistent supplies of water for human con- <br />sumption, fire suppression and economic devel- <br />opment, and to protect and enhance the natural <br />environment. The provisions contained in this <br />13.50.150 <br />Chapter shall apply to all water users and prop- <br />erties served by the Town's potable water deliv- <br />ery system, whether located inside or outside the <br />Town's geographical limits. (Ord. 5 §1, 2002) <br />13.60.020 Water supply shortages; <br />mandatory use restrictions. <br />(a) Mandatory water conservation measures <br />and use restrictions as set forth in this Section <br />shall be effective and enforced whenever the <br />Board of Selectmen declares by written resolu- <br />tion adopted at a regular or special meeting that a <br />water shortage exists, or is threatened to immi- <br />nently occur, and that water use must be <br />restricted in the interests of public health and <br />safety. Mandatory water use restrictions shall be <br />imposed whenever one (1) or more of the fol- <br />lowing circumstances occur: <br />(1) The Colorado Department of Natural <br />Resources, through the State Engineer or duly <br />authorized Division Engineer, or a court of <br />competent jurisdiction, issues a notice and/or <br />order (call out) directing the total or partial <br />discontinuance by the Town of water diver- <br />sions needed to supply the Town's water sys- <br />tem. <br />(2) Daily demand on the Town's water <br />supply system for water service exceeds, or is <br />anticipated to exceed, ninety-five percent <br />(95%) of the system's water treatment capac- <br />ity. <br />(3) The Town's raw water supply or <br />water treatment facilities are insufficient or <br />unable to satisfy daily water use demand, or <br />anticipated water use demand, by reason of <br />drought, mechanical or infrastructure failure, <br />or natural or man-made catastrophe. <br />(b) Whenever the Board of Selectmen <br />declares that a water shortage exists or is threat- <br />ened to imminently occur and that water use <br />restrictions shall be implemented and enforced, a <br />13-29 <br />
