AGENCY: <br />NA <br />None <br />None <br />WEATHER: <br />INSP ATURE: <br />SIGNATURE DATE: <br />Clear <br />July 8, 2015 <br />The following inspection topics were identified as having Problems or Possible Violations OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to repair the erosion gully located in the <br />southeast corner of the Consolidated Mutual property between the east bank of the Platte River and the <br />Aggregate Industries property line after the 2013 flood event. Therefore, the Division believes Northern <br />Colorado Constructors failed to maintain the prevailing hydrologic balance in the area as required by Rule 3.1.6 <br />and Section 34-32.5-116(4)(h) of the Colorado Land Reclamation Act for the Extraction of Construction <br />Materials. <br />CORRECTIVE ACTIONS: The Operator must work with the Army Corps of Engineers and Aggregate Industries to <br />return the Platte River to its channel within 10 days of the mailing date of this report. <br />CORRECTIVE ACTION DUE DATE: 7/18/15 <br />INSPECTION TOPIC: Off-site Damage <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to repair the erosion gully located in the <br />southeast corner of the Consolidated Mutual property between the east bank of the Platte River and the <br />Aggregate Industries property line after the 2013 flood event. Therefore, the Division believes Northern <br />Colorado Constructors failed to protect areas outside the affected land from slides and other damage as <br />required by Rule 3.1.5(3) and Section 34-32.5-116(4)(1) and (j) of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials. <br />CORRECTIVE ACTIONS: The Operator must submit a plan, in the form of a technical revision, to restore the flood <br />damaged land owned by Consolidated Mutual and Aggregate Industries adjacent to the Platte River within 30 <br />days of the mailing date of this report. <br />CORRECTIVE ACTION DUE DATE: 8/07/15 <br />Page I of 5 <br />
