The following inspection topics were identified as having Problems or Possible Violations OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
INSPECTION TOPIC: Hydrologic Balance
PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to repair the erosion gully located in the
southeast corner of the Consolidated Mutual property between the east bank of the Platte River and the
Aggregate Industries property line after the 2013 flood event. Therefore, the Division believes Northern
Colorado Constructors failed to maintain the prevailing hydrologic balance in the area as required by Rule 3.1.6
and Section 34-32.5-116(4)(h) of the Colorado Land Reclamation Act for the Extraction of Construction
Materials.
CORRECTIVE ACTIONS: The Operator must work with the Army Corps of Engineers and Aggregate Industries to
return the Platte River to its channel within 10 days of the mailing date of this report.
CORRECTIVE ACTION DUE DATE: 7/18/15
INSPECTION TOPIC: Off-site Damage
PROBLEM/POSSIBLE VIOLATION: Problem: The Operator failed to repair the erosion gully located in the
southeast corner of the Consolidated Mutual property between the east bank of the Platte River and the
Aggregate Industries property line after the 2013 flood event. Therefore, the Division believes Northern
Colorado Constructors failed to protect areas outside the affected land from slides and other damage as
required by Rule 3.1.5(3) and Section 34-32.5-116(4)(1) and (j) of the Colorado Land Reclamation Act for the
Extraction of Construction Materials.
CORRECTIVE ACTIONS: The Operator must submit a plan, in the form of a technical revision, to restore the flood
damaged land owned by Consolidated Mutual and Aggregate Industries adjacent to the Platte River within 30
days of the mailing date of this report.
