Box 1710 <br />Idaho Springs, CO 80452 <br />RE: Notice of Intent to Conduct Prospecting Application; Queen Elizabeth Mine; <br />File No. P-2015-006; Second Notice of Deficiencies <br />Dear Mr. Myers, <br />On April 15, 2015, the Division of Reclamation, Mining and Safety (Division) received the <br />Notice of Intent (NOI) to Conduct Prospecting Application for Queen Elizabeth Mine, File No. <br />P-2015-006. The Application was filed for review on April 15, 2015. Our review indicates the <br />NOI application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal, and <br />Designated Mining Operations. The Division requires the information described below before we <br />can approve the NOI application. <br />1. The Applicant has not specified a date for the completion of the proposed prospecting <br />project. The proposed dates of commencement and completion are not enforceable; however <br />the Division requests these dates for informational purposes only. Please specify the <br />anticipated date of completion. <br />2. The Applicant has provided descriptions of the existing closures on the upper and lower <br />portal. Please specify if these closures will be removed during the course of the prospecting <br />project. If the closures will be removed, then the Division will have to include the cost of <br />replacing the closure in the financial warranty calculation. If the closures will not be <br />removed, then please provide a commitment to keep the closures in place. <br />Be advised that if these items have not been addressed within 60 days of the date of this letter <br />(July 6, 2015), the Division may terminate the NOI application in accordance with Rule 5.1.3(c) <br />of the Hard Rock Rules. <br />OF COC <br />Q' <br />IN O <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining. state. co. us <br />John W.
