XIV. Protection of Underground Mining <br />No specific approvals granted under this section. <br />XV. Subsidence Control <br />A. The applicant has proposed a subsidence control plan in accordance with Rule <br />2.05.6(6) and has committed to adopt all measures in order to reduce the likelihood <br />of subsidence, prevent material damage, or mitigate the effects. The Division <br />proposes to approve the plan (4.20.1(2) and 4.20.3(1)). <br />B. The applicant conducted a subsidence monitoring program, in accordance with <br />Rule 2.05.6(6)(c), designed to determine the commencement and magnitude of <br />subsidence movements. The results of the monitoring program were submitted to <br />the Division semi annually. The monitoring program was designed to extend for a <br />time, beyond cessation of mining in any area, consistent with the need for <br />verification of the subsidence prediction. Technical Revision # 46 that was <br />approved in October 1997 terminated subsidence monitoring. <br />XVI. Concurrent Surface and Underground Mining <br />No specific approvals granted under this section. <br />XVII. Operations on Alluvial Valley Floors <br />A. The Division has determined that an alluvial valley floor exists within the affected <br />or adjacent area. Therefore, the following findings are in order for the alluvial <br />valley floor known as the Picketwire Valley located along the Purgatoire River. <br />i. The Division finds that activities proposed by the applicant will not <br />interrupt, discontinue, or preclude farming on the alluvial valley floors that <br />are irrigated or naturally subirrigated (4.24.3(1)). <br />ii. The proposed activities will not materially damage the quantity or quality <br />of water in the surface or ground water system described above (4.24.3(3) <br />and 2.06.8(5)(a)(ii)). <br />iii. The operation produced coal in commercial quantities and was located <br />within or adjacent to an alluvial valley floor prior to August 3, 1977 <br />(4.24.3(4)(a) and 2.06.8(5)(b)(i)(A)). <br />Therefore the operations within a specific geographic area may continue despite <br />their proximity to an alluvial valley floor. The specific geographic area has been <br />delineated as the actual extent of mine workings on August 3, 1977 and adjacent <br />area for which there existed substantial demonstrable financial or regulatory <br />16 <br />
