PERMIT #: M-1986-048 <br />INSPECTOR'S INITIALS: ECS <br />INSPECTION DATE: July 1, 2015 <br />OBSERVATIONS <br />This was an inspection of the Nicholson Pit, a 49.9 acre 112c permit recently transferred to RW Yetter Sand & <br />Gravel LLC. This inspection was conducted by Eric Scott of DRMS to determine the adequacy of the existing <br />bond, and to identify issues that may need to be addressed by the new permittees to insure compliance with <br />the permit going forward. This permit is located on the north side of Morgan County Road GG between <br />County Road 35 and the county line between Morgan and Logan counties. The required site identification sign <br />was present, but will need to be updated. The current disturbed acreage at the site totals approximately 10 <br />acres, with approximately 6 acres in the currently active area of the pit. <br />Two significant issues were identified and discussed with the permittees during this inspection. The first issue <br />that needs to be resolved at this time is the lack of any existing permit boundary markers. At this time, the <br />location of the permit boundary cannot be determined by either existing boundary markers or DRMS records. <br />The permittee will need to re-establish the 49.9 acre permit area, properly mark the permit boundary, and <br />submit documentation including a permit boundary map and marker locations to DRMS as a technical revision <br />by the corrective action date listed on the first page of this inspection report. <br />The second issue noted by DRMS is that a fairly significant high -wall (approx. 500 feet long and 30 feet high) <br />had been created in the working area of the site (see attached photos). The mining plan does not currently <br />include provisions for this type of mining, and will therefore need to be revised to include the presence of a <br />high wall at the working face through a technical revision if this practice will continue to be used at the site. <br />It should also be noted that the continued presence of an extensive high wall at the site will have an impact on <br />the required reclamation bond, and will require a significant bond increase if it is not either greatly reduced or <br />eliminated. The existing high wall should be reduced to a 3:1 or flatter slope in all areas other than the <br />currently active working face.
