Revised page 2.05-184.11 indicates a copy of the existing subsidence agreement with the powerline <br />operators has been forwarded to the Division. The agreements the Division has on file in Exhibit 7 -Dl are <br />from 1995 and 1996 Please provide updated letters from the owners of the powerlines that might be <br />impacted that state that the owners of the powerlines are aware of the potential impacts and of the <br />proposed mitigation/repair measures proposed for mining in the WCR. <br />Response: - The one powerline (Yampa Valley Electric) which will potentially be affected by the activities <br />proposed under PR10 is covered by an existing easement agreement which allows for undermining and subsidence <br />of the line. A copy of the agreement is provided with these responses for insertion in Exhibit 2. <br />22. According to the table of contents for the Exhibit 7K, there are 15 total drawings included with the <br />evaluation. Exhibit 7K only included drawings 1 to 4. Please ensure all of the drawings, tables and <br />figures are included when the revised subsidence evaluation exhibit is submitted. <br />Response: - The revised and updated subsidence evaluation and associated text revisions provided as a <br />supplemental submittal on March 19, 2015 address this Comment. <br />23. Revised page 2.05-181.11 indicates pasturelands overlie the WCR. Pasturelands fall under the definition <br />of renewable resource lands in accordance with Rule 1.04(111). Please revise this section of the permit to <br />include a description of the worst possible consequences that subsidence will have on this renewable <br />resource land in accordance with Rule 2.05.6(6)(b) and if necessary a monitoring plan, subsidence survey <br />and subsidence control plan. <br />Response: - The referenced text discussion has been expanded to describe potential subsidence -related impacts to <br />those areas of pastureland which overlie the proposed Wolf Creek mining area. As noted, subsidence effects will <br />be negligible relative to the pastureland use, so monitoring, surveys, and subsidence control plans are not applicable <br />or relevant. <br />24. Revised page 2.05-184.10 does not follow the text preceding it on the currently approved page 2.05-184.9. <br />Revised page 2.05-184-.10 appears to begin with information regarding the Fish Creek and Associated <br />AVF on the previous section of the permit. This page also omits or deletes a paragraph under a section <br />titled Stock Ponds and Surface Water Monitoring Sites on the currently approved page 2.05-184.9. <br />Please review this proposed revised page and adjust it to follow the text from the currently approved page <br />2.05-184.9. <br />Response: - The referenced page and text section have been reviewed and revised to address the noted concern <br />with text continuity. Revised copies of the corresponding pages accompany these responses for replacement in the <br />PAP. <br />25. Rule 2.05.6(6) (c) (ii) requires that the application shall include an appropriate map, prepared according to <br />the standards of section 2.10, showing the location of monuments to be installed and structures to be <br />monitored within the permit and adjacent area. Revised pages 2.05-191.8 and 191.9 indicate that TC will <br />monitor monuments along RCR33 and the Railroad. The Division could not locate a map in the permit that <br />depicts the monuments/subsidence reference points used to monitor subsidence related impacts to these <br />structures. Please submit a map that complies with the cited rule. <br />Response: - Revisions and updates to the accompanying Map 23WC include delineation of those areas where <br />subsidence monitoring points will be established to monitor subsidence of RCR33, the UP Railroad Spur, and the <br />YVEA Powerline. <br />
