Box 1488 <br />Paonia, CO 81428 <br />RE: Bowie Resources, LLC, Permit C-1996-083 <br />May 2015 Discharge Monitoring Report (CO-0044776) <br />Dear Mr. Bear: <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) has reviewed and found the above <br />referenced report to be in compliance with Rule 4.05.13(2). The May 2015 Discharge Monitoring Report <br />for the above referenced CDPS Permit was received via email by the Division on 30 June 2015; the reports <br />cover the time period from 01 May 2015 through 30 May 2015. <br />During the month of May 2015 only outfalls 001A, 004A, and 005A flowed. The Division noted that the 30- <br />day average of 30 mg/L for Total Suspended Solids (TSS) was exceeded at outfall 004A with a value of 34 <br />mg/L during the May reporting period. This is the second month in a row in which the TSS 30-day average <br />has been exceeded. Please acknowledge that this exceedance is correct and if so, please provide <br />information that this exceedance was reported to the CWQCD. <br />The Division noted that the 30-day average of 30 mg/L was exceeded at outfall 004A with a value of 34 <br />mg/L in April and requested information pertaining to the excedance be submitted to the Division. BRL <br />acknowledged that this exceedance is correct and provided information that this exceedance was <br />reported to the CWQCD in an email received by the Division on 16 June 2015. <br />It is noted that based on a Memorandum of Understanding between the Division of Reclamation, Mining <br />and Safety and the Water Quality Control Division (WQCD), the WQCD will be responsible for enforcing <br />CDPS permit conditions including the above referenced exceedance. <br />1313 Sherman Street, Room 215, Denver, CO 80203P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br /> <br />John W.
