QUARTERLY COAL WASTE BANK INSPECTION REPORT <br />CDMR Rules 4.09. ](11) and 4.10.2(2) <br />Mine: New Elk Mine <br />Waste Bank MSHA ID. No.: Development Waste Disposal Area #2 <br />Inspection Period: _ Second Quarter 2015 <br />Inspection Date: <br />General Description or Reference to Site Plan: <br />The Refuse Disposal Area is located south of State Highway 12 and east of the main Mine Access Road. <br />It is adjacent to the north of the Middle Fork of the Purgatoire River. The area was used for disposal of <br />waste rock from underground mining and disposal of sediment from ponds and ditches located within the <br />mine permit area. <br />Activity during Inspection: <br />The DWDA#2 site has been completed and the operator has shaped most of the pile to the final surface <br />grade. The operator is evaluating alternative uses for this site that may result in removal of the pile and <br />permit revisions of the area. No problems observed during the inspection <br />Drainage: <br />No springs or seeps were observed on the refuse side slopes. Positive drainage is established on all areas, <br />with little to no erosion. <br />Observation of Fill Construction: <br />Fill construction has been completed. <br />Indications of Potential Failure or Instability: <br />None observed. Surface and out slopes were inspected for potential failure. <br />Threat to Human Life or Property: <br />None observed. Location and placement minimalize any potential impacts to life or property. <br />Potential Harm to Land, Air, and Resources: <br />None observed. <br />Maintenance Required: <br />No additional unscheduled work required at the time of this inspection. Note ditch line may need to be <br />cleaned out depending on perception within the next quarter. <br />Supporting Documentation: <br />None required at this time. <br />3595 <br />1 Spector MSHA Id # <br />Supervising P.E. �. <br />
