2. Designed, constructed and maintained in compliance with rules 4.05.6 <br />and 4.05.9. for detailed analysis of rule 4.05.9 please see page 8 <br />3. Maintained and designed to 10 yr 24 hour event <br />4. Spillways comply with 4.05.9(2) see review of Rule 4.06.9 on page 8 <br />5. Modeling and supporting documents included <br />6. Reclaimed and permanent ponds 4.05.9. <br />The general requirements of Rule 4.05.6 (1) have been adequately met in the <br />permit section Appendix Q Vol. VII -B section XVI. <br />The general requirements of design, construction and maintenance have been well <br />met and outlined in Table 4.8.6 in Volume 4, in permit sections 4.8 Appendix Q and <br />Maps M51, 1-3, and in Annual and Quarterly Pond and Impoundment Reports, <br />meeting the requirements of Rule 4.05.6(2),(3) and (5). <br />For the more detailed requirements the following questions come up: <br />Question: There are no as built drawings for the ponds listed below, making it difficult to <br />assess portions 3b, 3c and 5 of rule 4.05.6. Please provide as builts that indicate elevations <br />for all spillways, including both the primary and emergency spillways where applicable for <br />the ponds, or indicate where in the permit information regarding Rule 4.05.6(3b), (3c) and <br />(5) are located: <br />East Pyeatt #3 Johnson #6, #711, #8R. #911, #1011 <br />Middle Pyeatt #1, #2, #3 No Name #2, #4 and #5R <br />Ute <br />♦ Question: Please add a discussion on how short circuiting of ponds has been prevented <br />for each pond in accordance with rule 4.05.6(6) <br />For adequacy with respect to Rule 4.05.6(2), (4) and (7) and rule 4.05.9 please see <br />the adequacy review of rule 4.05.9 on page 8 of this document. <br />Rule: 4.05.7 Discharge Structures <br />Discharge structure design as per Rule 4.05.7 has been adequately addressed in <br />the permit and include: <br />1. Permit section 4.8.1.2 of Volume 4 addresses all drainage from disturbed <br />areas. Diversion ditch designs were modified as per TR -25 <br />2.
