Michael Cunningham <br />Division of Reclamation, Mining and Safety <br />1313 Sherman St., Room 215 <br />Denver, CO 80203 <br />Dear Mr. Cunningham, <br />RE: Notice of 112 Hard Rock Reclamation Permit Application Consideration <br />JRS Mining LLC, Sullivan Aggregate Pit, File No. M-2015-017 <br />This is in response to a Public Notice that was posted in The Flume newspaper <br />regarding the above application. As a resident of Park County and nearby <br />homeowner of this property, I have several concerns. <br />1. There is increased mining activity especially between Fairplay and Alma, CO. <br />There have been numerous grievances and safety issues against the various <br />mining operations on the South Platte River including detrimental affects to <br />aquatic habitat. Now you want to add additional impact? <br />I know for Federal permits you need to have a NEPA study. Is this required <br />for state permits? For land that has not been previously disturbed and/or <br />new permits, shouldn't studies be required to determine the effects to <br />wildlife, air pollution, river and aquatic life disturbance, archeology, <br />paleontology and general biology? What are the potential affects to cultural <br />and natural resources? Local agency representatives should be able to assist <br />with an accurate assessment of impact. The results of the actions done on <br />these properties extend beyond the permit boundaries. <br />3. While the operations are on land zoned for mining, the area immediately <br />adjacent is zoned residential. The impact was unbearable last year and a <br />second mining operation will only increase a multitude of issues. There is no <br />effort being made by the mining operations to reach out to the affected <br />homeowners to discuss a way to co -exist. We have recently asked our county <br />commissioners to address the issues and we request your assistance in <br />giving us enough time to find a remedy. <br />
