Compliance With Mine Plan N - Support Facilities Not On-site <br /> N -Other N A- Special Categories Of Mining <br /> N A-Processing Waste Y -Topsoil <br /> COMMENTS <br /> This partial inspection of Elk Creek Mine outside Sommerset,Colorado was conducted on Thursday the <br /> 25th of June2015. Ground conditions were damp and muddy in places. However,roads that were previously <br /> impasable were now accessible. The day was mostly sunny and 80T with cumulus clouds gathering in the <br /> afternoon. <br /> Robin Reilley accompanied by Jim Stark both of the Division of Reclamation Mining and Safety(DRMS) <br /> conducted the inspection. A portion of the inspection consisted of verifying compliance with outstanding aspects <br /> of a Notice of Violoation(NOV)with the intention of terminating the NOV if possible. Doug Smith and Jim <br /> Kiger were present representing the mine. Jim and Doug described the current"on the ground"conditions at the <br /> site,ongoing projects,and Jim went over draft maps being prepared for a pending permit revision. Weed <br /> mitigation in the form of spraying is taking place where weeds have been identified. The Bear Creek fan has been <br /> dismantled and this area will be prepared for reclamation and a technical revision. <br /> The auction was going on with active bidding taking place at the time of inspection. Oxbow is not currently <br /> mining or shipping coal. <br /> SIGNS AND MARKERS Rule 4.02: <br /> • Mine Identification signs and surface disturbance markers identified during this inspection were installed <br /> as required throughout the areas visited. <br /> • Topsoil stockpiles observed were marked with identifying signs. <br /> ROADS Rule— 4. 03 <br /> Construction 4.03.1(3)/4.03.2(3); Drainage 4.03.1(4)/4.03.2(4); Surfacing and Maintenance 4.03.1(5) and <br /> (6)/4.03.2(5) and(6); Reclamation 4.03.1(7)/4.03.2(7): <br /> Number of Partial Inspection this Fiscal Year: 8 <br /> Number of Complete Inspections this Fiscal Year: 4 <br /> Page 2 of 5 <br />
