AM -05 was <br />called complete for review on April 16, 2015. Please be advised that if you are unable to satisfactorily <br />address any concerns identified in this review before the decision date, it will be your responsibility to <br />request an extension of the review period. If there are outstanding issues that have not been adequately <br />addressed prior to the end of the review period, and no extension has been requested, the Division will <br />deny AM -05. In order to allow the Division adequate time to review your responses to any adequacy <br />issues, please submit your adequacy responses to the Division no later than one week prior to the decision <br />date (July 15, 2015). <br />This review consisted of comparing the application with specific requirements of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction Materials <br />(Rules). In general, the application was adequate; however, as with most applications there are a few <br />items that will require the submittal of additional information or clarification of the existing information. <br />Inadequacies are identified under the respective exhibits, along with suggested actions to correct them. <br />APPLICATION FORM: <br />1) The application states that the current permit area is 82.96 acres. Through AM -05 the <br />Application/Operator is purposing adding 22.06 acres, for the access road and additional land located <br />southwest of the current operation. After conducting a file review the Division determined that the <br />permit area is 92 acres, 82.96 acres delaminates the active affected area, in addition to the homestead <br />area 9.04 acres. The homestead area was incorporated within the permit boundary in a previous <br />permit amendment. Therefore, the first page of the application should state under item 3 that the <br />"current permit area" is 92 acres.
