Compliance With Mine Plan <br />N - Support Facilities Not On-site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />N - Topsoil <br />COMMENTS <br />This was a complete inspection of the Terror Creek Loadout conducted by Jim Stark of the Colorado Division of <br />Reclamation, Mining and Safety. Robin Reilley, also representing the Division and Jim Kiger and Doug Smith, <br />representing Terror Creek, LLC, accompanied me on the inspection. The Terror Creek Loadout has basically <br />stopped operating and currently being reclaimed. The weather was sunny and the dry. <br />HYDROLOGIC BALANCE - Rule 4.05: Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9; Stream Buffer Zones 4.05.18: <br />- The sediment pond contained a small pool of water and was not discharging at the time of the inspection. The <br />embankment was well vegetated and stable and no erosional problems were noted. <br />- The dugout pond was dry at the time of the inspection. The pond was well vegetated and stable and no erosional <br />problems were noted. <br />- The ditches along the haul road and the lower yard area were all clean and stable at the time of the inspection. <br />No erosional problems were noted in any of the ditches. <br />- The operator has drilled the three alluvial wells along (north of) the siding track. There is no well caring <br />extending above the ground surface and the casings have a cement collar. These wells were approved in Minor <br />Revision 28. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />- The only structures that remain at the upper office/shop bench are the concrete pad from the shop, two old <br />trailers and the old house that was used for the office. There is also some miscellaneous debris on the bench. <br />- The operator has removed all but a small portion of the crushing and screening plant and the truck scale and scale <br />house from the lower bench. All of the concrete footers and wing walls also remain. There is also a small section <br />of conveyor that remains in the area of the old coal fines pile. <br />- The operator has removed the vast majority of the structures from the site. It was indicated that the concrete and <br />reclaim tunnels will not be removed at this point.
