Failure to transport and place <br />on Gob Pile 2 refuse material in horizontal lifts in a controlled manner and <br />concurrently compact as necessary to ensure mass stability and prevent mass <br />movement as required by Rule 4.09.1(7). Failure to consider the steepness of <br />slopes seepage and other visible factors which could indicate potential failure as <br />part of the quarterly inspection as required by Rule 4.10.2(c). Failure to maintain <br />a minimum static safety factor of 1 5 on Gob Pile 2 as required by Rule 4.10.4(2). <br />Failure to divert surface runoff from the fill surface to stabilized channels off the <br />fill which will safely pass the runoff from a 100 year 24 hour precipitation event on <br />Gob Pile 2 and Gob Pile 4 as required by Rules 4.10.1 (1) a and 4.09.2(7). <br />(3)(c) No administrative or judicial actions. <br />(3)(d) The violation has been abated. <br />(3)(e) The Applicant placed and compacted all existing end dumped material on Gob <br />Pile 2 in accordance with the Rules and approved permit application package, <br />removed cover fill material from ditches D F5 and D 176 and repair or reconstruct <br />all lateral ditches on Gob Piles 2 and 4 to ensure positive drainage as designed <br />in the approved permit application package and conducted quarterly inspections <br />of Gob Pile 2 in accordance with all of the requirements of Rule 4.10.2 beginning <br />with the second quarter of 2013. <br />(3)(f) The notice of violation was terminated October 4, 2013. <br />PR -14 2.03 -11 06/14 <br />
