KAMPER <br />CKAMPER@CSMKF.COM <br />303.893.1825 <br />Re: New Horizon Mine 2, Permit No. C-1981-008, Minor Permit Revision No. 92. <br />With this letter, Western Fuels -Colorado, a Limited Liability Company ("Western Fuels - <br />Colorado") submits to the Division of Mining, Reclamation, and Safety (the "Division") and the <br />Mined Land Reclamation Board ("MLRB") a revised Map 2.03.4-1, Surface Ownership and <br />Leases, to be consistent with the current information shown by Montrose County GIS. <br />Western Fuels -Colorado is doing so solely in response to the direction provided by the Division <br />in its correspondence dated June 9, 2015. The revised map does not reflect Western Fuels - <br />Colorado's view of where the property boundaries shown on the map are, or should be, located. <br />In fact, Western Fuels -Colorado takes no position on the location of such boundaries as a matter <br />of property law or title. Rather, Western Fuels -Colorado is simply following the direction <br />provided by the Division that it interprets Coal Rule 2.10.3(1)(a) and 2.03.3(1) as requiring <br />"information that is currently available through the Montrose County Assessor's Office, and <br />(00259369.1) <br />
