June 10, 2015 C-1981-012/New Elk Mine JHB <br />The former Topsoil stockpile No. 2 area east of DWDA 92 requires maintenance of the silt fence at the south end <br />of this SAE silt trap. The silt fence has been undercut. Resetting and proper anchoring of the silt fence is needed <br />at this location. <br />PROCESSING WASTE/COAL MINE WASTE PILES — Rule 4.10 and 4.11 <br />Drainage Control; Surface Stabilization; Placement: <br />NECC was in the process of hauling coal development waste from the mine facilities on the south side of <br />the river, to the Refuse Disposal Area (RDA) on the north side of the river. One truck was being used at the time <br />of the inspection. The highway was being swept of any spilled coal waste material after every crossing of the haul <br />truck. Material was being placed and spread at the north west portion of the pile. The compactor was not running <br />at the time of the inspection. <br />Drainage off the pile was mostly satisfactory. Some gullying of the active sides was occurring on the east side, <br />just to the west of the conveyor extension (North of C88). Although this gullying is contained within the Pond 8 <br />drainage area, it adds additional sediment into the armored drainage and ultimately into the pond. <br />The highest active face of the refuse pile needs to be reshaped and the topmost bench needs to be cleaned of <br />sediment and shaped. The berm between the top reclaimed face and the un -reclaimed bench is only several inches <br />in spots. The Division is concerned that sediment from the active bench will breach through this low berm and <br />spill down the reclaimed face of the RDA. Ron said that NECC already had it on their maintenance schedule. The <br />Division is concerned with the frequent thunderstorms that there is little sediment storage left in the lower berm <br />areas. The Division advises NECC to re-establish a higher berm by June 30th. This can be done by removing <br />some of the refuse material from the bench and placing it higher up on the active lift. <br />ROADS — Rule 4.03 <br />Construction 4.03.1(3)/4.03.2(3) <br />Drainage 4.03.1(4)/4.03.2(4) <br />Surfacing and Maintenance4.03.1(5) and (6)/4.03.2(5) and (6) <br />The ditches along the RDA haul road are beginning to fill with rocks sloughing off the road cuts. NECC <br />needs continued maintenance along these ditches. Culverts along the RDA Haul road are well maintained and <br />functioning well. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />Reference areas were observed. The grassland reference area is located on the Bosque Del Oso State <br />Wildlife Area at the released Golden Eagle mine. The grassland reference area was being sampled by a vegetation <br />crew in conjunction with reclaimed area sampling at the remaining portion of the Golden Eagle Mine. The <br />grassland reference area is a north facing pasture on the south side of the Purgatory River. The Grassland <br />reference area had not been grazed this season, and had a diverse healthy smooth brome, blue grama mixed grass <br />community established. This pasture is fenced. <br />The Willow -Carr (WC) reference area was also inspected. This reference area is located along the south edge of <br />the Purgatory river.
