PERMIT #: M-1998-101 <br />INSPECTOR'S INITIALS: TOD <br />INSPECTION DATE: April 24, 2015 <br />INSPECTION TOPIC: Off -Site Damage and Gen. Compliance With Mine Plan <br />POSSIBLE VIOLATION: Land has been affected outside of the approved permit boundary. This is a possible <br />violation at this time pursuant to: C.R.S. 34-32.5-109(1) for failure to first obtain from the Board or the Division <br />a reclamation permit prior to engaging in a new operation. <br />CORRECTIVE ACTIONS: This possible violation will require a hearing before the Mined Land Reclamation <br />Board. The schedule and other details for the Board hearing will be provided under a separate document to be <br />sent via certified mail to the Operator. <br />CORRECTIVE ACTION DUE DATE: To be determined during the July 29, 2015, Board Hearing <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM: The affected area boundary markers are missing or incorrectly placed. This is a problem for <br />failure to maintain boundary markers around the affected area as required by Rule 3.1.12(2) of the rule. <br />CORRECTIVE ACTIONS: The operator shall conduct a survey and replace the boundary markers in the <br />correct location(s). The Operator shall provide proof to the Division that this has been done by the corrective <br />action date. <br />CORRECTIVE ACTION DUE DATE: 7/13/2015 <br />INSPECTION TOPIC: Revegetation <br />PROBLEM: Tamarisk (salt cedar) trees are present within or have volunteered into the permit area and <br />becoming established. This is a problem for failure to employ weed control methods for a state listed noxi <br />weed species within the permitted area, and to reduce the spread of weeds to nearby areas as required by Sect <br />3.1.10 (6) of the Rules. <br />CORRECTIVE ACTIONS: The Operator shall either implement the existing weed control plan, or develop <br />weed control and management plan in accordance with Section 3.1.10 (6) of the Rules. This plan should 1 <br />developed in consultation with the county extension agency, or weed control district office and should incluc <br />specific control measures to be applied, a schedule for when control measures will be applied and a po. <br />treatment monitoring plan. This weed control plan shall be submitted to the Division as a Technical Revision <br />the approved plan with the appropriate Technical Revision fee of $216.00 by the corrective action dat <br />CORRECTIVE ACTION DUE DATE: 7/13/2015 <br />OBSERVATIONS <br />This routine monitoring inspection was conducted by Tyler O'Donnell of the Division of Reclamation, Mining and <br />Safety (Division). Tony J. Beltramo and Sons, Inc., the Operator, was represented by Gene Harris during the <br />inspection. <br />The Cesar Pit is located in Pueblo County approximately 4 miles south-southeast of Pueblo, Colorado. The Cesar Pit <br />is a 160 -acre 112c Construction Materials Reclamation Permit, with a maximum allowed disturbed area of 90 acres. <br />The permit was issued in March of 1999. The primary commodity mined at the site is sand and gravel. The <br />approved post -mining land use is rangeland. The mine site was surrounded by the following land uses: <br />industrial/commercial, residential, agricultural, rangeland, and mining. <br />The mining operation was active during the inspection. The Operator was processing and stockpiling material. <br />There were multiple stockpiles of product scattered throughout the site. At the present time it appears that the <br />mining operation has affected approximately 73 acres. The mining operation appears to be progressing from south <br />to north. Active mining is taking place in a portion of the pit just west of the livestock corrals. The remaining <br />portions of the site appeared to be mostly mined out. A portion of the site located south-southwest of the livestock <br />corrals has been backfilled and graded. <br />Page 2 of 9 <br />
