The followine inspection tonics were identified as havine Problems or Possible Violations. OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
INSPECTION TOPIC: Backfilling & Grading
PROBLEM/POSSIBLE VIOLATION: Problem: The approved Mine Plan requires the Operator to maintain a 25
foot offset from the property line and mine the perimeter at the final 3HAV slope. The northeastern highwall
has been mined to within ten feet of the permit boundary and exceeds the approved perimeter mined slope of
3HAV.
CORRECTIVE ACTIONS: The Division will require the Operator to backfill the highwall to establish the required
25 foot offset from the eastern boundary and the required 3HAV slope and provide evidence within 60 days of
the mailing date of this report.

INSPECTION TOPIC: Hydrologic Balance / Wash Pond
PROBLEM/POSSIBLE VIOLATION: Problem: A wash pond containing water is located in the northeast corner of
the pit floor. The Division was not able to determine if the source of the water in the former wash pond was
groundwater or trapped stormwater.
CORRECTIVE ACTIONS: The Division will require the Operator to backfill the pond to 2 feet above the water
surface and provide evidence within 60 days of the mailing date of this inspection report.
