Page 3
June 10, 2015
King Coal Mine (C-1981-035)
MT -07 Report Section 2.05.2
This section indicates a mine life of six to nine years. With a start date of 2007, the termination date would be
2016. The report text, however, notes a date range of 2021 to 2024, and the meaning of these dates with
respect to the life of the mine is not clear. An extension of the existing termination date, assumed to be 2016,
if so implied, is not supported.
Overall Comments
It is not clear that mid-term reviews have been occurring on a 5 -year interval. In any case, we request that
these reviews and other periodic monitoring be diligently implemented due to the significant impact of King
Coal within the county.
Finally, we note that identification of impacts to Threatened and Endangered species and submittal of a Fish
and Wildlife Plan were requested by DRMS' MT -07 and as required by Rule 2.04.11 and 2.05.6. These items,
however, were not included with the GCC's MT -07 Report, and therefore we question whether the application
is complete for the purposes of filing.
Due to the impacts of this project within the County, we request party status in this mid-term review and
associated permit revisions.
Thank you again for the opportunity to comment and for your consideration.
Sincerely,
9;fiecrz dj'&U
Victoria Schmitt, PE
La Plata County Planning Engineer
Cc: Joe Kerby, County Manager
Damian Peduto, Community Development Director
Daniel Murray, Senior Planner
Sheryl Rogers, County Attorney
