It is our understanding that TR -24 is in response to the Division of Reclamation, Mining and Safety's <br />MT -07. As the applicant uses the term MT -07 in their documents, we will use that term herein, though with <br />the intention our comments applying to either the TR -24 or MT -07 as is relevant. <br />This letter references an April 30, 2015 Response Letter from GCC to DRMS and a May 5, 2015 Mid -Term <br />Review Report (MT -07) submitted by GCC. (Note the date of May 5, 2015 is taken from the footer of the Table <br />of Contents pages, although the footer in the remainder of the document indicates April 30, 2015. <br />Additionally, the MT -07 Report pagination is not correct, and therefore referencing herein is limited to section <br />numbers.) <br />MT -07 Report Section 2.03.8 <br />The meaning of the acreage reported is not clear. The MT -07 Response indicated 2,374.89 acres are affected <br />by both King I and King 11. The MT -07 Report indicates 2,702.77 acres are affected though it is not indicated <br />whether this value addresses King I and King II or only King 11. Either way, the values do not appear to be <br />reconcilable. <br />The manner in which 2,702.77 acres was reached in the MT -07 Report is not clear as surface facilities are <br />reported to extend 25.50 acres; and the underground mining 487.45 acres. <br />Also, it appears most of the mining area (up to 2,702.77 acres) underlies tribal land, while the non -tribal land <br />within the permit area appears to be only approximately 721 acres (parcel 565336200077). Are tribal lands <br />appropriately included in the DRMS permit area and in the absence of an Office of Surface Mining (OSM) <br />permit? <br />
