COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Stf, R,, / i', <br />Denver, Cotorado 80203 <br />June 9, 2015 <br />Fred Marvel <br />Brannan Sand & Gravel Company <br />2500 East Brannan way <br />Denver, CO 80229 <br />Re: Pit 29, DRMS Permit No. M-1980-183, <br />Amendment to the Reclamation Permit Amendment Application No. 2 (AM -02) <br />Preliminary Adequacy Review <br />Dear Mr. Marvel: <br />The Division of Reclamation, Mining, and Safety (Division) has completed its preliminary adequacy <br />review of your Amendment to the 112 construction materials reclamation permit amendment No. 2 <br />(AM -02). The Amendment to AM -02 was called complete for review on April 7, 2015. Please be <br />advised that if you are unable to satisfactorily address any concerns identified in this review before the <br />decision date, it will be your responsibility to request an extension of the review period. If there are <br />outstanding issues that have not been adequately addressed prior to the end of the review period, and no <br />extension has been requested, the Division will deny AM -02. In order to allow the Division adequate <br />time to review your responses to any adequacy issues, please submit your adequacy responses to the <br />Division no later than one week prior to the decision date (July 6, 2015). <br />This review consisted of comparing the application with specific requirements of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for the Extraction of Construction <br />Materials (Rules). In general, the application was adequate; however, as with most applications there <br />are a few items that will require the submittal of additional information or clarification of the existing <br />information. Inadequacies are identified under the respective exhibits, along with suggested actions to <br />correct them. <br />EXHIBIT N - Source of Legal Riaht to Enter (Rule 6.4.14): <br />1) The western portion of the proposed french drain is located on property owned by Henderson <br />Aggregates. Please demonstrate that the Applicant/Operator has legal right to enter the property <br />owned by Henderson Aggregates. <br />2) The western portion of the proposed french drain crosses property owned by Adams County. <br />Please demonstrate that the Applicant/Operator has legal right to enter the property owned by <br />Adams County to construct the french drain. <br />EXHIBIT S - Permanent Man -Made Structures (Rule 6.4.19): <br />oF' cow, <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining. state. co. us <br />John W.
