Eric Fry <br />Page 2 <br />June 4, 2015 <br />With respect to the Yoast and Seneca IIW mines, the monitoring programs were amended in 2010 in <br />similar ways: the monitoring of some sites was temporarily suspended; the frequency of monitoring other <br />sites was temporarily reduced; and the suite of water quality parameters to be tested for was temporarily <br />reduced, where appropriate. A similar qualification was also made in both cases: that the full monitoring <br />program be restored for a full year prior to final bond release. <br />The 2014 Annual Reclamation Reports for the two mines in question show that there are still considerable <br />acreages that have not received phase II bond release. It should be noted that the CDPHE tends to <br />consider phase II bond release as the minimum standard to be met before a permitted discharge point <br />treating a surface disturbance can be terminated. This is likely to be a hurdle that must be overcome <br />before water monitoring can be terminated entirely. <br />I hope that my comments have been helpful.
