The Board imposes a CIVIL PENALTY for thirty-six (36) days of violation at <br />$100 per day for a civil penalty of $3,600 pursuant to section 34-32-124(7), G.R.S. <br />All but $500 of the $3,600 civil penalty is suspended if the Operator complies with <br />the corrective action in the time specified. The portion of the civil penalty not <br />suspended, $500, shall be due and payable within thirty (30) days of the effective <br />date of this Order. If the Operator does not timely comply with the corrective <br />action, then the suspended portion of the civil penalty, in the amount of $3,100, <br />shall be due and payable within thirty (30) days of the deadline to complete the <br />corrective action.
